What Is the Ruling on Breaking an Oath, and What Is It Called in the Sharia?
What is the ruling for breaking an oath? And what is breaking an oath called in Shariah?
The answer explains that breaking an oath is called hinth and requires expiation, and that breaking it takes one of three rulings: obligatory when the oath was to leave a duty or do a forbidden act, such as cutting family ties; forbidden when the oath was to leave a forbidden act or do a duty; and permissible when it concerns a permissible matter.
The flexibility of Islamic jurisprudence ensures that an oath cannot be used as an excuse to commit a sin or abandon a religious duty. Therefore, evaluating the oath is absolutely necessary to determine the correct and righteous course of action.
Terminology and Consequence
Breaking an oath is called "Hanith" in Shariah. If a person decides to go back on their word and break the oath, breaking the oath entails atonement. Whoever breaks his oath must offer Kaffarah to expiate it.
The Three Rulings on Breaking an Oath
There are three rulings on breaking an oath based on the situation:
1. Obligatory (Wajib)
It may be obligatory when one takes an oath to leave an obligatory matter or do a forbidden act, such as taking an oath to sever one's kinship ties. In this case, he must break his oath to avoid committing a sin.
2. Forbidden (Haram)
It may be forbidden for him to break the oath when one takes an oath to leave a forbidden matter or to do an obligatory one. Since the action sworn upon aligns with Islamic duties, maintaining the oath becomes mandatory.
3. Permissible (Mubah)
It may be permissible if he swears about leaving a permissible matter or doing it. The individual has the absolute choice to proceed with the oath or to break it, provided they pay the atonement if they choose the latter.
1. Do Not Make Allah's Name a Barrier to Good | ولا تجعلوا الله عرضة لأيمانكم
Allah says: do not make Allah, by your oaths, a barrier against doing good, being mindful of Him, and making peace between people (Al-Baqarah 2:224). Ibn Kathir explains: do not let your oaths by Allah prevent you from righteousness and keeping family ties when you have sworn to abandon them; persisting in such an oath is more sinful for its owner than leaving it by expiation. This is the obligatory breaking in the answer.
2. Persisting in an Oath Against One's Family |
The Prophet said: By Allah, for one of you to persist in his oath concerning his family is more sinful for him with Allah than to pay the expiation Allah has prescribed for him (Sahih al-Bukhari 6625).
3. Abu Bakr's Oath About Mistah |
Abu Bakr used to spend on his poor relative Mistah, and after Mistah spoke against Aisha, he swore: By Allah, I will never spend anything on Mistah. Allah revealed: let not those of grace and means among you swear to withhold giving to relatives, the poor, and those who emigrated in the cause of Allah; let them pardon and overlook; do you not love that Allah should forgive you? Abu Bakr said: Yes, by Allah, I love that Allah forgives me, and resumed spending on him (Sahih al-Bukhari 4750; An-Nur 24:22).
Scholarly Insight: An oath must never become a barrier to good: Ibn Kathir explains Al-Baqarah 2:224 as forbidding people to let their oaths keep them from righteousness and family ties, and the Prophet said that persisting in an oath against one's family is more sinful than paying the expiation (Sahih al-Bukhari 6625). When Abu Bakr swore to stop spending on Mistah, Allah revealed An-Nur 24:22 and he resumed (Sahih al-Bukhari 4750). Read more in the tafsir of Surah Al-Baqarah.
