Is It Permissible to Take Cash Loans From Conventional Banks That Do Not Follow Islamic Law?
Is it permissible for a person to take cash loans from traditional commercial banks that do not comply with the Islamic law?
The answer rules that a Muslim may not take interest loans from conventional banks, gives a worked example of a $2,000 loan repaid as $3,600, and explains that this is the same as the pre-Islamic riba on debts, which the Quran forbids and the Prophet cursed.
Islamic law strictly prohibits transactions involving interest, directing believers to lawful financial alternatives instead of conventional bank loans.
Commercial Bank Loans and Riba
1. The Prohibition of Traditional Bank Loans
It is not permissible for a Muslim to deal with loans with traditional commercial banks that do not comply with Islamic law, especially with regard to loans, the traditional bank is based on the idea of lending with interest.
2. A Practical Example
Example: The bank gives the client a loan of $2,000, with the customer paying back the amount of $3,600 over equal monthly installments for 36 months; each month $100 for a total of $3,600, a direct interest loan on capital. So this is exactly the interest that Allah Almighty has forbidden.
3. The Severe Warning in the Quran
(O believers! Fear Allah, and give up outstanding interest if you are true believers. If you do not, then beware of a war with Allah and His Messenger! But if you repent, you may retain your principal, neither inflicting nor suffering harm.) Al-Baqara 2: 278 to 279.
4. The Historical Context of Riba
This is because the people in Jahiliya (age of ignorance) dealt with loans, and when the loan comes to term, the debtor says to the creditor: "If you can defer the payment of the loan, I will compensate you by increasing the amount." Or the debtor tells the lender: "If you can defer payment of the loan in exchange for the increase in the value of repayment." And that is the principle of loans that banks deal with today and therefore this is how the economy is established in our contemporary world.
5. The Prophetic Curse on Usury
Jabir said: "Allah’s Messenger ﷺ cursed the one who consumes riba, the one who pays it, the one who records it, and its two witnesses, and he said: they are all alike" (Sahih Muslim 1598).
Note: In Sahih Muslim 1598, Jabir reports that the Messenger of Allah cursed those involved in riba; the quotation, which read "Allah cursed", has been corrected to that wording.
1. Interest on Loans in Contemporary Rulings |
The Islamic Research Academy in Cairo, at its second conference in 1965 with representatives of thirty-five Muslim countries, resolved that interest on all kinds of loans is forbidden riba. The International Islamic Fiqh Academy ruled in Jeddah in 1985 that any increase on a due debt in return for deferring it, and interest on a loan from the start of the contract, are both forbidden riba (Resolution 10 (10/2)).
2. Doubled and Multiplied |
Allah forbids believers to consume riba doubled and multiplied (Al-Imran 3:130), which describes the pre-Islamic practice explained in the answer, where a debt grew each time its payment was deferred. In his Farewell Sermon the Prophet declared the riba of the pre-Islamic era abolished, beginning with the riba owed to his uncle al-Abbas ibn Abd al-Muttalib (Sahih Muslim 1218).
3. Repentance and the Principal |
In the same passage Allah opens the door of repentance: those who repent keep their principal, neither wronging nor being wronged (Al-Baqarah 2:279). He also commands giving a debtor in hardship time until he is able to pay, and says that remitting the debt as charity is better (2:280).
Scholarly Insight: The Islamic Research Academy in Cairo (1965) resolved that interest on all kinds of loans is forbidden riba, and the International Islamic Fiqh Academy (Resolution 10 (10/2), 1985) ruled the same for interest on a loan from the start of the contract. Jurists often cite the maxim: "Every loan that draws a benefit is Riba." Taking out a loan that requires paying back the principal amount plus a fixed or variable percentage is categorically forbidden. The severity of this sin is emphasized by the Prophetic Hadith which places the curse of Allah not only on the bank collecting the interest, but equally on the customer paying it, the clerk recording the transaction, and the witnesses to the contract (Sahih Muslim 1598).
Frequently Asked Questions |
Is the interest charged by modern banks considered riba?
Yes. Any amount required above the original borrowed principal is riba, and the answer compares it to the pre-Islamic increase of a debt in return for more time. The International Islamic Fiqh Academy ruled interest on a loan from the start of the contract to be forbidden riba (Resolution 10 (10/2), 1985).
Is the person borrowing the money also committing a sin, or just the bank?
Both. Jabir reported that the Messenger of Allah cursed the one who consumes riba, the one who pays it, the one who records it, and its two witnesses, and said that they are all alike (Sahih Muslim 1598).
What are the consequences of dealing with riba in Islam?
Allah warns those who do not give up riba of war from Allah and His Messenger (Al-Baqarah 2:278-279), and the Prophet counted consuming riba among the seven destructive sins (Sahih al-Bukhari 2766).
Can someone who took an interest loan repent?
Yes. Allah says that those who repent keep their principal, neither wronging nor being wronged (Al-Baqarah 2:279). Repentance means stopping, regretting what was done, and resolving not to return to it.
