Does the Rule of a Son's Double Share Still Apply When Women Work Today?
Nowadays, many women work and contribute to home finances. Does the text regarding inheritance where the share of the male is twice that of the female still apply?
In Islamic law, the inheritance shares are divine decrees that remain unchanged by modern circumstances. A woman's voluntary financial contribution to her household does not alter the fixed inheritance rules, which primarily apply to siblings or children sharing the same degree of kinship, rather than spouses.
The Islamic inheritance system is a comprehensive divine framework that is completely independent of individual household financial arrangements or modern societal trends.
Can a working woman ask for her money back if she spends it on the house?
Yes, but only if she explicitly considered and communicated that the money was a loan to her husband at the time of spending. If she spent it with the intention of a voluntary contribution, she cannot demand it back.
Does the rule of the male getting twice the share apply between a husband and a wife?
No. The rule where the male receives twice the share of the female applies primarily to relatives sharing the exact same degree of kinship to the deceased, such as a son and a daughter, or a brother and a sister. Spouses inherit the separate fixed shares given in Surah An-Nisa 4:12: a husband receives one half or one quarter, and a wife one quarter or one eighth.
Why cannot we change inheritance laws if modern societal roles change?
Because inheritance shares are a direct, fixed decree from Allah, entirely similar to the obligation of daily prayers. They do not change based on evolving human opinions, nor can they be altered based on an individual woman's voluntary choice to work and spend.
Evaluating Modern Financial Contributions
1. Voluntary Expense Versus Loan
First, when a woman contributes to her home expenses, she can choose between two things. She can either spend her money considering it a voluntary expense, or she can consider it as a loan to her husband. In the first case, where it is a voluntary expense, she will not get her money back. However, in the second case, she can explicitly ask her husband to return her money when he is financially able to do so.
2. The Scope of the Inheritance Rule
Second, the Ayah that states a male's share will be equal to that of two females is not related to spouses. Rather, it refers to the inheritance of male and female relatives in cases where their kinship to the deceased is exactly the same, such as a brother and a sister, or a son and a daughter. As for the spouses, there is no correlation between a woman spending voluntarily and giving her more than her rightful, fixed share in the estate.
3. The Immutability of Divine Law
Thirdly, the legacy and inheritance system is a strict decree by Allah, just like the obligatory prayers, and this does not change according to human opinions. Furthermore, not all women are the same in giving their money and spending on the household. Some give to their husbands, and others do not.
4. Human Nature and Wealth
Fourth, by human nature, the more wealth a person acquires, the more miserly they tend to become.
Scholarly Insight: In Islamic Jurisprudence, the rights and obligations ordained by Allah are universally applicable and do not shift based on individual choices. While it is commendable for a woman to assist her family financially, doing so is her personal choice, not a religious or legal obligation. The inheritance shares, however, are based on the compulsory, non negotiable financial responsibilities placed upon men by Allah, such as paying the dowry and providing mandatory maintenance. Because human behaviors vary greatly from one home to another, Allah established fixed, divine laws that apply universally, guaranteeing absolute justice beyond human opinions.
1. The Permanence of Divine Boundaries (Tilka Hudood Allah) |
Directly after outlining inheritance portions, Surah An-Nisa delivers an unalterable verdict: "These are the limits [set by] Allah... And whoever disobeys Allah and His Messenger and transgresses His limits, He will put him into the Fire" (4:13-14). Inheritance shares are not mutable human policies, but fixed divine decrees.
2. Men Retain Unchanging Legal Financial Obligation |
Even in contemporary times, Islamic law does not oblige a working wife to pay the household's rent, food, or bills; that duty remains on her husband. Even if a wife earns ten times more than her husband, he owes her full living maintenance under Islamic law.
3. A Working Woman's Spending: Rewarded Benevolence, Not Tax |
When modern women contribute to their home finances, Islam categorizes this as voluntary benevolence (Sadaqah and Ihsan), for which they receive immense spiritual reward. Conflating voluntary spousal generosity with structural statutory inheritance changes fundamentally distorts the Islamic legal architecture.
4. The Stability of Divine Wisdom Over Fleeting Circumstances |
Human economic realities fluctuate: women may work in one generation and stay home in another, or suffer employment crises. Divine legislation is designed for permanent societal equilibrium across all eras. Altering inheritance laws based on temporary economic cycles shatters social cohesion and family kinship.
Scholarly Insight: Divine inheritance laws operate as unalterable legal boundaries (Hudood Allah), ensuring that enduring social stability takes precedence over fluctuating economic conventions. Read more in the tafsir of Surah An-Nisa.
