What Are the Conditions for Having to Pay Zakat?
What are the conditions that apply for having to pay zakat?
The primary condition for the obligation of Zakat is being a Muslim. Uniquely among acts of worship, Zakat is tied to the wealth itself; therefore, it is also compulsory on the qualifying wealth of minors and the insane, requiring their guardians to pay it on their behalf.
The conditions for Zakat define upon whom this financial worship becomes a binding duty.
Is Zakat required from someone who is not Muslim?
No, being a Muslim is the primary condition for Zakat. It is an act of worship and purification that is only accepted from believers.
Does a child have to pay Zakat on their wealth?
Yes, Zakat is compulsory on the qualifying wealth of a young Muslim child. Since the obligation is tied to the wealth itself, the child's guardian must calculate and pay it on their behalf.
Who is responsible for paying the Zakat of an insane person?
If an insane person possesses wealth that meets the conditions for Zakat, their legal guardian is responsible for taking the correct portion from their wealth and paying it to the deserving categories.
The Core Condition of Zakat
1. Islam and the Wealth of Minors
That a person is Muslim, It is also compulsory for money belonging to a young Muslim child and an insane person who is Muslim, in which case, the guardian should pay the Zakat for them. (Zakat is an act of purification accepted only from believers. Furthermore, because the obligation is attached to the wealth itself once it reaches the minimum threshold [Nisab] and a full lunar year [Hawl] passes over it, legal accountability [Takleef] is not a condition. The guardian acts on behalf of those without legal capacity to fulfill this divine duty and protect the rights of the poor).
Scholarly Insight: In Islamic Jurisprudence (Fiqh), the conditions of Zakat distinguish it from physical acts of worship like prayer or fasting. While prayer requires sanity and puberty (Takleef) to be obligatory, Zakat is fundamentally a right attached to the wealth itself (Haqq fil-Mal). Therefore, if a minor or an insane person possesses wealth that meets the minimum threshold (Nisab) and remains in their possession for a full lunar year (Hawl), their appointed guardian is strictly obligated to pay it on their behalf. This ensures that the rights of the poor and the socio-economic balance of the community are consistently maintained, regardless of the wealth owner's mental capacity or age.
1. Islam and Absolute Independent Ownership (Milk Tamm) |
Islam and qualifying ownership are central conditions for Zakat. A non-Muslim is not required to make a Zakat payment as a Muslim act of worship before embracing Islam. The owner must possess the kind of legal ownership required for the asset. Lost or seized property and money owed to the owner have additional rules under the applicable school. The majority require a guardian to pay Zakat from a minor's qualifying wealth.
2. Reaching the Minimum Threshold (Nisab) |
The Nisab is the minimum threshold for the relevant kind of wealth. The gold threshold is twenty dinars, commonly estimated at about 85 grams of pure gold, and the silver threshold is two hundred dirhams, commonly estimated at about 595 grams. These modern gram estimates express the classical gold and silver measures. Cash valuations follow a gold or silver basis under the ruling adopted.
3. The Passage of One Lunar Year (Al-Hawl) |
Cash, gold, silver, trade goods, and qualifying grazing livestock generally have a lunar-year requirement, with further rules for profits and increases. Aisha's report says that no Zakat is due on wealth until a year has passed (Sunan Ibn Majah 1792, graded sahih by al-Albani; al-Arnaut graded it sahih through supporting reports). The schools have detailed rules on profits, increases, and changes in the Nisab.
4. Exemption of the Annual Cycle for Agricultural Crops |
Unlike monetary savings, agricultural produce (grains and fruits) is exempt from the one-year waiting period. Zakat on crops becomes due at harvest, as commanded in Surah Al-An'am: "And pay its due upon the harvest day" (6:141). Sahih al-Bukhari 1483 gives one tenth for rain or spring irrigation and half a tenth for irrigation by drawing water. The Maliki, Shafi'i, and Hanbali majority require five Wasqs for qualifying produce, while Abu Hanifa does not require that threshold; the liable crops also differ by school. Rikaz has a separate one-fifth due (Sahih al-Bukhari 1499) without a Hawl. The Shafi'i new position requires Nisab and gold or silver for Rikaz. Minerals are distinct: the Shafi'i rule for gold and silver minerals is one fortieth at Nisab without a Hawl.
Scholarly Insight: The conditions of Nisab and Hawl apply according to the asset and the school followed. Personal needs and debts have school-specific rules, and crops are assessed at harvest without a Hawl. Read more in the tafsir of Surah Al-An'am.
