What should the lender do if he finds the borrower is not able to pay back due to financial difficulties?
Islamic finance balances the strict obligation of repaying debts with profound compassion and mercy for those who fall into genuine financial hardship.
Dealing with an Insolvent Debtor |
1. The Obligation of Leniency
If the lender finds out that the borrower is financially unable to pay back his loan, then he should be lenient, and should not put any pressure on him to repay it. Doing so may lead to the borrower doing something illegal which may land him in prison. Allah ordained that the lender postpone the debt until a time of ease.
2. The Quranic Command
(If it is difficult for someone to repay a debt, postpone it until a time of ease. And if you waive it as an act of charity, it will be better for you, if only you knew.) Al-Baqara 2: 280.
3. The Virtue of Waiving the Debt
It is desirable for the creditor to write off the debt if the debtor is poor, so he should be kind as Allah was Kind to him, and Muslims should seek to relieve the poor of their debts.
Scholarly Insight: In Islamic Jurisprudence (Fiqh), dealing with an insolvent debtor (Mu'sir) requires mandatory respite (Inthar). Scholars state that intentionally bankrupting or imprisoning a person who genuinely has no wealth contradicts the core Islamic objectives of mercy and social solidarity. The Prophet Muhammad pbuh explicitly stated that whoever grants respite to a debtor in difficulty, or forgives the debt entirely, Allah will shade them on the Day of Judgment. This transforms a financial loss into an eternal spiritual investment.
Frequently Asked Questions |
Can a lender force an insolvent borrower to go to prison?
No. If it is proven that the borrower is genuinely insolvent and has no hidden wealth, it is strictly forbidden in Islam to pressure them or cause their imprisonment. The lender must give them time until their financial situation improves.
Is it mandatory to forgive the debt of a poor person?
Forgiving the debt entirely is highly recommended and carries an immense spiritual reward, but it is not a strict legal obligation. The only strict obligation is to grant them an extension of time.
What does the Quran say about a debtor in hardship?
Surah Al Baqara commands that if the debtor is in difficulty, they must be granted a postponement until a time of ease, and it highlights that waiving the debt as an act of charity is even better for the lender.
