What is the difference between orphan sponsorship and adoption?

تعتبر حماية النسب الحقيقي للطفل مسألة عدالة عميقة في الإسلام. ويفرق الدين بشكل واضح بين توفير الرعاية المحبة لليتيم وبين نسبه زورا إلى سلالة دم جديدة.
1. The Concept of Adoption | التبني في الجاهلية والإسلام
A Pre Islamic Practice: Adoption is from the acts of ignorance that continued until the beginning of Islam, until it was eventually forbidden. In this practice, the adoptive parent made the orphan one of his own biological children, gave him his name, and treated him as a Mahram (a blood relative whom one cannot marry).
من أفعال الجاهلية: التبني من أفعال الجاهلية التي استمرت إلى بداية أمر الإسلام إلى أن ورد تحريمها. حيث كان المتبني يجعل اليتيم كأبنائه الذين من صلبه، ويدعى باسمه، ويحل له محارمه.
The Prohibition: The Prophet pbuh adopted Zaid bin Harith, and he was named Zaid bin Mohammed until Islam definitively forbade that practice in a verse of the Quran to preserve true lineage.
Allah Almighty says: (Let your adopted children keep their family names. That is more just in the sight of Allah. But if you do not know their fathers, then they are simply your fellow believers and close associates.) Surah Al Ahzab 33: 5.
التحريم القرآني: وقد تبنى الرسول صلى الله عليه وسلم زيد بن حارثة، وكان يدعى زيد بن محمد إلى أن حرم الإسلام ذلك بنص القرآن.
قال الله تعالى: (ادْعُوهُمْ لِآبَائِهِمْ هُوَ أَقْسَطُ عِندَ اللَّهِ ۚ فَإِن لَّمْ تَعْلَمُوا آبَاءَهُمْ فَإِخْوَانُكُمْ فِي الدِّينِ وَمَوَالِيكُمْ) الأحزاب 33: 5.
2. Orphan Sponsorship | كفالة اليتيم
Whereas sponsorship of an orphan is free of all prohibitions. It provides all the love, shelter, and financial support a child needs, without the legal violations of adoption. Specifically, it prevents the forbidden inheritance between the adoptive parents and the orphan. Furthermore, the orphan never carries the sponsor's name, as it is not permissible to attach a lineage to anyone other than the true father.
أما كفالة اليتيم: فتخلو من جميع المحذورات وهي التوارث بين المتبني واليتيم. فاليتيم يحظى بالرعاية التامة ولكنه لا يحمل اسم الكافل أبدا، ولا يحق إلحاق النسب بغير الأب الحقيقي.
Scholarly Insight: Islamic scholars explain that prohibiting adoption was not meant to discourage taking care of orphans. On the contrary, Islam strongly encourages sponsorship (Kafalah). The prohibition specifically targets the falsification of reality. Can an orphan take the family name of their sponsor?

Does a sponsored orphan inherit from the sponsor?
No. Because they are not biologically related, the sponsored orphan does not automatically inherit from the sponsor. However, the sponsor can voluntarily leave a portion of their wealth to the orphan through a documented will (Wasiyyah).
Did the Prophet Muhammad practice adoption?
The Prophet pbuh had adopted Zaid bin Harith before the revelation came down prohibiting the practice. Once the Quranic verses were revealed forbidding adoption, Zaid's name was respectfully changed back to Zaid bin Harith, establishing the new Islamic law.
