The Severe Warning | التحذير الشديد
Islam has warned people against consuming an orphan's money unjustly, and if someone consumes an orphan's money unjustly, it entails many severe penalties.
The people of Islamic knowledge say that every morsel or drink that a person takes from the orphan's money unjustly is like putting fire in his stomach. So, spending and wasting the money of the orphan causes Allah's Wrath and punishment. It is important to note that "consuming" does not only refer to eating; rather, every act of wasting, destroying, or harming the orphan's money exposes the perpetrator to the torment of Allah.
حذر الإسلام من أكل مال اليتيم بغير حق، ورتب على ذلك عقوبات كثيرة تطال أكل مال اليتيم ظلما.
فيقول أهل العلم إن كل لقمة أو شربة يأخذها شخص من مال اليتيم بغير وجه حق، فكأنما يضع في بطنه نارا. وليس الأكل المراد به الأكل على وجه الخصوص، بل إن كل تضييع لمال اليتيم أو إتلافه أو الإضرار به، يعرض آكله لعذاب الله.

Consuming an orphan's money has two practical forms in everyday life:

The First Form (Forbidden)
He takes possession of the orphan's money and makes it his own, and prevents the orphan from all or part of the money. This is strictly forbidden theft. Allah the Almighty says: (Indeed, those who unjustly consume orphans' wealth in fact consume nothing but fire into their bellies. And they will be burned in a blazing Hell!) Surah An Nisa'a 4: 10.

أن يستأثر بمال اليتيم ويجعله له، ويمنع اليتيم من المال كله أو من بعضه، فذلك محرم. قال الله تعالى: (إِنَّ الَّذِينَ يَأْكُلُونَ أَمْوَالَ الْيَتَامَىٰ ظُلْمًا إِنَّمَا يَأْكُلُونَ فِي بُطُونِهِمْ نَارًا ۖ وَسَيَصْلَوْنَ سَعِيرًا) النساء 4: 10.
The Second Form (Permissible)
Mixing some of the orphan's money that the guardian spends on him with the money of the guardian. In this case, it is permissible to spend from that mixed money for shared living, provided that mixing the money is not intended to deceive the orphan and secretly spend from his money.
Allah the Almighty says: (And they ask you O Prophet concerning orphans. Say, "Improving their condition is best. And if you partner with them, they are bonded with you in faith. And Allah knows who intends harm and who intends good. Had Allah willed, He could have made it difficult for you. Surely Allah is Almighty, All Wise.") Surah Al Baqara 2: 220.

أن يختلط شيء من مال اليتيم الذي ينفق عليه منه بمال الولي، فيجوز أن يأكل من ذلك المال المخلوط بشرط ألا يقصد من الخلط التحايل إلى أكل مال اليتيم.
كما قال تعالى: (وَيَسْأَلُونَكَ عَنِ الْيَتَامَىٰ ۖ قُلْ إِصْلَاحٌ لَّهُمْ خَيْرٌ ۖ وَإِن تُخَالِطُوهُمْ فَإِخْوَانُكُمْ ۚ وَاللَّهُ يَعْلَمُ الْمُفْسِدَ مِنَ الْمُصْلِحِ ۚ وَلَوْ شَاءَ اللَّهُ لَأَعْنَتَكُمْ ۚ إِنَّ اللَّهَ عَزِيزٌ حَكِيمٌ) البقرة 2: 220.
Scholarly Insight: Early Muslims were so terrified by the severe warning in Surah An Nisa'a that they began completely separating the orphan's food from their own food, to the point where the orphan's food would sometimes spoil while the family ate something else. Recognizing this hardship, Allah revealed the verse in Surah Al Baqara to bring ease. The Quran allows guardians to pool resources and eat together as one family, as long as the underlying intention is to protect and improve the orphan's wealth, not to secretly exploit it.
